1. OVERVIEW AND ACCEPTANCE
This Privacy Policy (“Policy”) governs the collection, use, disclosure, and protection of personal information by Micmic (“the App”, “we”, “us”, or “our”). This Policy applies to our mobile application, website, and all related services (collectively, the “Service”).
By installing, accessing, or using the Service, you (the “User”) acknowledge that you have read, understood, and agreed to be bound by the terms of this Privacy Policy. This Policy is incorporated into and subject to our Terms of Conditons. If you do not agree with any part of this Policy, you must immediately cease all use of the Service and delete the App from your device.
2. CHILDREN’S PRIVACY
The Service is restricted to individuals aged 13 and older (or 16 in certain EU jurisdictions). We do not knowingly collect data from children. If we become aware of a violation, we will terminate the account and purge the data within 24 hours.
3. INFORMATION WE COLLECT
We collect various types of information to provide a sophisticated AI-driven experience and to maintain the financial integrity of our subscription model.
3.1. User-Provided Content (The "Source Media")
In order to use the “Photo to AI Dance Video” feature, you provide us with:
- Photographs and Images: You must grant us access to your camera or photo library to upload images. These images are the core input for our AI motion transfer algorithms.
- User Prompts: Any text or style selections you provide to guide the AI generation process.
3.2. Personally Identifiable Information
- Account Information: If you register an account, we collect your email address, name, and profile picture.
- Third-Party Login Data: If you use "Sign in with Apple" or "Facebook Login," we receive a unique identifier (token) and associated public profile information (e.g., name, email) as permitted by the provider’s privacy settings.
3.3. Facial Data and Biometric Information
Our Service utilizes advanced neural networks to detect facial landmarks and body pose coordinates to synchronize movement.
- Nature of Data: We analyze pixels to identify facial features (eyes, nose, mouth) and body joints.
- Purpose: This analysis is strictly used for the mathematical mapping of dance animations onto your static photo.
- Non-Identification: We do not use this data to uniquely identify or authenticate you. We do not build a biometric database of our users.
- Retention: All facial and body coordinate data is transient and is purged immediately following the generation of the video output.
3.4. Automatically Collected Information & Tracking
Through our integration with the Facebook (Meta) SDK and other analytics tools, we collect:
- Device Identifiers: IDFA (Identifier for Advertisers), IDFV (Identifier for Vendors), and IP addresses.
- Device Characteristics: Device model, OS version, battery level, screen resolution, and network type.
- Engagement Metrics: Sessions started, features used (e.g., "Trending Dance Templates"), subscription conversion events, and ad interaction data.
3.5. Transactional Data
- Purchase History: We track your "Credit" balance and subscription status (Active/Expired).
- Payment Security: We do not process or store credit card numbers. All payments are processed through the Apple In-App Purchase (IAP) system, which is subject to Apple’s Privacy Policy.
4. HOW WE USE YOUR INFORMATION
We utilize the collected data for the following legal and business purposes:
- AI Content Generation: Running high-intensity GPU-based processing to create realistic AI dance videos.
- Personalization: Suggesting viral dance styles based on your usage history.
- Advertising and Attribution (Facebook/Meta): To measure the effectiveness of our marketing campaigns and to serve you relevant ads for our premium features on other platforms.
- Financial Record Keeping: Managing your subscription credits and ensuring that "Credit-based" usage is correctly deducted.
- Technical Support: Troubleshooting crashes and improving AI model stability.
- Legal Compliance: Protecting our rights and complying with law enforcement requests.
5. DATA SHARING AND THIRD-PARTY DISCLOSURE
We do not sell your personal data. We only share information in the following circumstances:
5.1. AI Model Providers (Sub-Processors)
To provide state-of-the-art video synthesis, your images are transmitted to our AI infrastructure partners (e.g., Fal.ai, Amazon Web Services, or Google Cloud). These partners:
- Act solely as service providers.
- Are contractually bound to delete your data after processing.
- Are prohibited from using your data to train their own independent AI models.
- Provides the same or equal data protection
5.2. Advertising and Analytics Partners
We share device identifiers (IDFA) and event data with:
- Meta (Facebook): To optimize our ad targeting and track user acquisition.
- Firebase/Google Analytics: To monitor real-time app performance.
5.3. Business Transfers
In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity, subject to the same privacy protections.
6. DATA RETENTION AND PURGING POLICY
We adhere to a strict "Data Minimization" principle:
- Media Data: Original photos and generated AI videos are cached on our servers for a maximum of 7 days. This allows you time to download your content.
- Facial Analysis Data: Deleted immediately after the video generation process is completed.
- Marketing Data: Identifiers used for advertising (like IDFA) are retained as long as permitted by the specific platform (Apple/Meta) or until you opt out.
7. INTERNATIONAL DATA TRANSFERS
Your information may be transferred to and processed in countries other than your own, including the United States. These countries may have different data protection laws. We implement "Standard Contractual Clauses" to ensure your data remains protected globally.
8. SECURITY MEASURES
We implement industry-standard security protocols, including:
- Encryption: Data is encrypted via HTTPS/TLS during transit and AES-256 at rest.
- Access Monitoring: Strict internal logging of all database access.
- Firewalls: Advanced network protection to prevent unauthorized intrusion.
9. USER CHOICES AND CONTROL
9.1. iOS Tracking Transparency (ATT)
Per Apple's requirements, we will ask for your permission to track you for advertising purposes. You can modify this at any time in Settings > Privacy > Tracking.
9.2. Accessing and Deleting Data
You have the right to:
- Request a copy of the data we hold.
- Request immediate deletion of your account and all associated data via the "Delete My Account" button in the App settings.
- Withdraw consent for camera/photo library access in your device settings.
10. CALIFORNIA (CCPA) AND EUROPEAN (GDPR) RIGHTS
- GDPR: You have the right to data portability, the right to object to processing based on "Legitimate Interests," and the right to lodge a complaint with a supervisory authority.
- CCPA: We do not "Sell" your personal information in the traditional sense. However, the sharing of identifiers for targeted advertising may be considered a "Sale" or "Sharing" under California law. You may opt out of this by disabling tracking.
